<r12a> here's my take on whether this is an issue: thank you for raising this issue, which is well worth noting, however the Encoding spec is attempting to document and make interoperable current browser support for non-Unicode encodings (it only refers to a subset of the current non-Unicode encodings), and and otherwise persuade everyone to move to correct use of UTF-8 encoded Unicode. For that reason, addressing the concerns you raise would be out of scope for the spec.
