"P.S. we need to determine in Seattle what permissions we need for DNT;0 and
where to note them down, which goes to the core of the EU system issue Roy
is coming back to. We need a positive definition of tracking. What does it
require at least. (in the US, receiving DNT;0 you may go beyond) I think
that the minimum permissions needed should not contain open ends."

Presumably DNT:0 means something along the lines of "yes, you may track me," but we come back to what exactly that entails. If we say "you may collect any data and use it for any purpose" this will not count as consent in the EU since there is not an associated context. Can we craft something that will work for everyone?

STATUS: Agreed; waiting for Heather to add to Compliance document (action-251) and then we close action-208, action-250, action-251, and issue-148.
We resolve to add normative text of: "When a user sends the DNT:0 signal, they are expressing a preference for a personalized experience. This signal indicates explicit consent for data collection, retention, processing, disclosure, and use by the recipient of this signal to provide a personalized experience for the user. This recommendation places no restrictions on data collected from requests received with DNT:0."
Plus additional non-normative text of: "This protocol does not define what constitutes explicit consent in any jurisdiction; check with your lawyer."

Agreed on 10/8/2014 call to go with language from TPE distinguishing between general DNT:0 preferences, and specific DNT:0 exceptions granted in response to a particular request for that exception. In the latter case, the scope of the consent is contingent upon whatever was messaged to the end user.
