9.5 (Floats) says:

  # 5. The outer top of a floating box may not be higher than the outer
  #    top of any block or floated box generated by an element earlier
  #    in the source document.

s/block or floated/floated or in-flow block/
since we need to exclude abspos boxes.

(It could be argued that abspos boxes are not block-level, which would remove the need to make the above change, but that would require us to make that statement explicit somewhere.)
