The query starts with

xquery version "2.0"; ...

and expects XQST0031.

The 3.1 specification gives processors complete freedom to decide which version numbers they should accept and reject, and there is no requirement explicitly stated that a version number is invalid if W3C has not published a specification with that version number.

Decided to fix the test to give alternative results of success or XQST0031.
