It's hard to believe this test has been around for over 10 years and has never been challenged, but it seems to me that the expected results of ns-queries-results-q1 are dependent on the order of items returned by distinct-values(), which is implementation-dependent.

Bug resolved by returning distinct values of the elements and attributes. Here we use assert-permutation in the outcome.
