Should the elements in the older shadow tree behave as if (1) they were
in the tree of the host, or as if (2) the older shadow tree was a 
disconnected dom subtree? This all assuming the newer tree doesn't have
a shadow insertion point.

I don't have a strong opinion on this, but it should be defined explicitly in the spec.

I think you might want to take a look at this issue:

The mentioned nodes should be categorized to (2), but not to (4).
