Is this referring to "When an element is added to the pending dialog stack, it must also be added to the top layer layer. When an element is removed from the pending dialog stack, it must be removed from the top layer. [FULLSCREEN]" ?

As far as I can tell, the fullscreen spec already handles the case of elements not being rendered. I don't want to have to manipulate the stack to maintain sane order myself. :-) Anne, can you confirm that you meant the top layer to transparently handle display:none elements and similar?

http://fullscreen.spec.whatwg.org/#characteristics handles that, no?
