Thanks for catching this. I checked in a fix to the validator sources: https://bitbucket.org/validator/syntax/commits/2f1cf96de71cd6ef966c14d463d9e75bdc0d5f6a And I will push that change to http://validator.w3.org/nu/ soon (by next week).
