I am unable to reproduce this.

This demo (click the link in the rendering area to test):
   http://software.hixie.ch/utilities/js/live-dom-viewer/saved/1945
...suggests that WebKit crashes, and Gecko and Opera do what the spec says.

Please reopen this bug with a testcase if you can demonstrate the problem in the spec (though it's clearly more subtle than the original description).
