I met F2F with the HTML working group to discuss this concern on 4 Nov 2010 in Lyon. Minutes of that discussion are available at http://www.w3.org/2010/11/04-html-wg-minutes.html (note that the date on those minutes is incorrect. The discussion was in fact on 4 Nov 2010).

I believe my concerns were heard and reasonably well understood. Henri Sivonen in particular seemed to share my concern, and to also believe that changes should be made to the HTML5 draft specification. The matter is now in the hands of the HTML WG and chairs, and is being tracked as
http://www.w3.org/html/wg/tracker/issues/140 .
