I think it is easier to define 'tracking', than to define 'not tracking'.  The definition does not need to include all the exceptions: they are better described individually, with their constraints, definition, and so on, in separate text.

Here is a simple definition:

"Tracking is the retention or use, after a transaction is complete, of data records that are, or can be, associated with a single user."

This knocks out aggregate non-individual counts, and doesn't consider in-transaction data while the transaction is in process (between request and response).
