I am surprised that the test fn-data-1 is expected to return an error.

For direct element constructors, the XQuery 1.0 spec seem to be clear that the typed value property for the newly constructed node is as follows (see item 5.i in 3.7.1.3 Content):

The typed-value property is equal to the string-value property, as an instance of xdt:untypedAtomic.

It just been a time issue.
