Hi there,

I noticed that when I attempted to check a page with no opening html tag, that this error was not caught by the validator.

I created a minimal test case for you to try.
http://mikemoreau.com/dev/html-open.html

When I validate this url it passes the test when it should not.

Am I misunderstanding this or is there a problem with the script? Thanks!

The opening html tag is optional in HTML 4.01:
http://www.w3.org/TR/html401/struct/global.html#edef-HTML

I'm not sure about HTML 5, but in any case, http://validator.nu passes your test case as valid too, which means that if this is an error, the bug should be reported according to the validator.nu bug reporting instructions:
