Submission request to W3C (W3C Team Comment)


We, W3C members International Business Machines Corporation, Microsoft Corporation, Allaire, Ariba, BEA, Bowstreet, Commerce One, Compaq Computer Corporation, DataChannel, Epicentric, Fujitsu Limited, Hewlett-Packard, Intel, IONA Technologies, Jamcracker, Lotus Development Corporation, Oracle, Rogue Wave, SAP, TIBCO, VeriSign, Vitria, webMethods, XML Global Technologies and XMLSolutions hereby submit to the Consortium the following specification, comprising the following document attached hereto:

  1. Web Services Description Language specification

We request the submission be known as the "WSDL" submission.

Abstract

WSDL is an XML format for describing network services as a set of endpoints operating on messages containing either document-oriented or procedure-oriented information. The operations and messages are described abstractly, and then bound to a concrete network protocol and message format to define an endpoint. Related concrete endpoints are combined into abstract endpoints (services). WSDL is extensible to allow description of endpoints and their messages regardless of what message formats or network protocols are used to communicate, however, the only bindings described in this document describe how to use WSDL in conjunction with SOAP 1.1, HTTP GET/POST, and MIME.

If implementation of a W3C standard based on the WSDL specification requires the use of Bowstreet patents or intellectual property, Bowstreet will grant, upon written request, a non-exclusive license under such patents or intellectual property on reasonable and non-discriminatory terms. Bowstreet expressly reserves all other rights it may have in the subject matter of its contribution.

Bowstreet expressly disclaims any and all warranties, express or implied, regarding this contribution including any warranty of merchantability, that this contribution does not violate the rights of others or is fit for a particular purpose.
Declaration of Commerce One:
Commerce One has not identified any intellectual property rights in the current submission, but Commerce One may identify that this or subsequent contributions to the W3C contain intellectual property rights. Commerce One reserves all rights with respect to such intellectual property, however, Commerce One agrees to make available to any W3C member on a fair, equitable, and reasonable basis rights to any such intellectual property as Commerce One may choose to contribute in this or future W3C work related to this submission.

Compaq agrees that, upon adoption of this contribution as a W3C Recommendation, any W3C member will be able to obtain a license from Compaq to implement and use the technology described in this contribution for the purposes of supporting the W3C Recommendation on a royalty-free basis. Epicentric believes that it may have patents and or patent applications (collectively "Patents") relevant to the Web Services Description Language (WSDL) Activity. However, Epicentric has not performed an analysis in order to determine which of its Patents may be relevant. Epicentric agrees now that any Epicentric Patents that read on a standard or specification adopted as a result of the WSDL Activity will be made available for license on reasonable and non-discriminatory terms to the extent necessary to implement the standard or specification.

Fujitsu agrees that, upon adoption of the submission in a W3C Recommendation, it will grant - on the basis of reciprocity for the submission - a license to an unrestricted number of applicants on a worldwide, non-discriminatory basis, and on reasonable terms and conditions to manufacture, use and/or sell implementations of the technology described in the submission and/or applications therefor under its patents or patent applications essential to such technology. Fujitsu expressly reserves all other rights it may have in the material and subject matter of this submission. Declaration of Intel:
Intel has not performed a search of its patent portfolio for the purpose of determining whether Intel has any patents or patent applications(collectively "Patents") that relate to Web Services Description Language. Intel is not willing to waive its rights in its relevant Patents, if any. However, Intel currently anticipates that its licensing policy for Patents that read on a future Proposed Recommendation relating to the Web Services Description Language will be to negotiate licenses on reasonable and nondiscriminatory terms. This policy shall apply only to Patent claims that read on Essential Technology. Essential Technology is as defined below. If Intel determines that it is not willing to grant licenses on reasonable and nondiscriminatory terms, Intel will endeavor to provide notification within four weeks following the release of the Proposed Recommendation. Neither Randy Hall, the XML Protocol Activity representative and contact for this co-submission, nor Wayne Carr, Intel's W3C AC Representative is personally aware of any relevant Intel patents or patent applications at this time.

The definition of essential technology is taken from the W3C Patent Policy Framework Proposal-W3C Working Draft 18 May 2000: "Definition of Essential Technology. 1. Essential means that an implementation of the specification would necessarily infringe claims of a patent or patent application owned or controlled by the Member at any time during the life of the Working Group and the specification. A claim is necessarily infringed hereunder only when it is not possible to avoid infringing it because there is no commercially plausible non-infringing alternative for implementing the specification, including the protocols, application program interfaces, service provider interfaces, and/or data structures disclosed with particularity in the specification in order to enable products to interoperate, interconnect or communicate as defined within the specification. 2. Notwithstanding the foregoing, essential claims shall not include any claims other than as set forth above even if contained in the same patent as essential claims; or that read solely on any implementations of any portion of the specification that are not required by the specification, or that, if licensed, would require a payment of royalties by the licensor to unaffiliated third parties. Suggested Action

We propose the formation of a new working group within the existing XML Protocol Activity to continue the evolution of this proposal. This working group will co-ordinate with other working groups within the Activity with the aim of developing interoperable and open standards for web-based services.
