Discussions are ongoing that JavaScript is not a text type but an application type. Furthermore, the term "JavaScript" is also to be replaced by the non-branded ECMA-Script:

http://www.rfc-editor.org/rfc/rfc4329.txt

Corresponding MIME types already exist.

I believe the upcoming HTML standard should reflect these discussions and use "application/ecmascript" instead of "text/javascript" as the preferred MIME type of script files.
