It's not warning text (that would be class=warning, it's red if you have a visual UA), it's just a note reminding authors of another thing that generates a mandatory warning.

Telling authors that the use will issue a conformance warning _is_ a warning, regardless of text color.

I believe that a reminder is appropriate here. If you disagree, please feel free to escalate  this to the chairs.

It has already been escalated to an Issue, and will continue to be LC blocking issue. 

Note, though, that this bug did not address whether the text was a "warning" or a "reminder" (and you need to consider people being color blind with your use of color). The bug focuses specifically on removing summary from the Conforming but obsolete section.

The HTML Accessibility Task Force intends to track these issues, per the proposal at http://lists.w3.org/Archives/Public/public-html-a11y/2010Jan/0245.html.
