Under the resolution of bug #5083, tests

K2-DirectConElementNamespace-36
K2-DirectConElementNamespace-37

should raise XQST0022 rather than XPST0003

This is also a legitimate response to

K2-DirectConElemNamespace-44

since on seeing the opening brace, the parser is entitled to decide that there is an enclosed expression present (which is error XQST0022) before it decides that the enclosed expression is invalid/not terminated.
