The escape \xXX is not allowed in the XML Schema regular expression syntax. The following tests in TestSet MS-Regex2006-07-15 break this rule. The tests are wrongly described as valid.

Agreed that these patterns (and therefore these schemas) are invalid.

RegexTest_440 data has the bug, but no test in the metaData actually refers to 
it as far as I can tell
