We believe that both of the following tests can be executed successful:
K-FunctionProlog-15 
K-FunctionProlog-33 

a) the errors being generated here are type errors. In http://www.w3.org/TR/xquery/#errors we read: A type error may be raised during the static analysis phase or the  dynamic evaluation phase.
b) assume an implementation raising it during the evaluation phase.
c) but the functions are never invoked, as such no error is reported and the query executes successful.

Yes, fixed in CVS by also allowing an output, in addition to XPTY0004.

Since this report was resolved as suggested, I am changing status to CLOSED.
