There is the following phrase in section 10.1:
"unless the element is a text node"

But interface Text (http://www.w3.org/TR/dom/#interface-text) is not a child of interface Element (http://www.w3.org/TR/dom/#interface-element). And thus it seems that element can't be a text node.

Thus IMO the following should be removed from this item - "the element is a text node or"
