After creating a new XQTS_current.zip from the latest sources from the W3C CVS by running 
ant -buildfile Build.xml
in Tools/ZipXQTS folder
one can notice that there is no
XQueryX/Basics/EQNames folder inside the XQTS_current.zip

The XQueryX/Basics/EQNames folder exists in the W3C CVS:

I am makring this as resolved - wontfix as we have moved forward to the QT3 test suite some time ago.
