The attached code contains error in table structure but isn't noticed by w3c validator. this is a validation issue that can cause problem using the w3c markup validator as official tool for validation for local governments.

While the missing "3.3" td cell might not be what the author intended, there's nothing wrong with it as far as validation is concerned.
