Test comp-elem-bad-name-1 expects XQDY0096 (the node-name of constructed element uses the prefix xmlns).  An implementation might not define the prefix "xmlns" in the statically known namespaces so I think it is OK to also raise XQDY0074 (name cannot be converted to an expanded QName).

Hi Josh,

in several implementation that I have tested, this is indeed the case, so I think you probably have a legitimate point. Unless prompted otherwise Iim enclined to make the change you have suggested.
