Gecko, Webkit, Presto, all allow positioning and floating legends, and just treat them as normal block children of the fieldset when that happens (Gecko in that situation will also allow styling them as display:table for now, but we may change that to match the others, who only allow "block").  I believe Trident may too, but haven't tested this.  This was a commonly reported bug against Gecko when it forced the legend-like display even when positioning or floating.

I opened bug 10771 on the fact that the new text doesn't actually match implementations very well.
