The issuance of trade marks was not conceived of in the context of a global view. Hence, a number of recent controversies have occurred with respect to large trade mark holders pursueing smaller "ma & pa" sites. Also, some sites have been purchasing competitors names or massive amounts of names in order to deprive a competitor of a fitting site name or to generate revenue from the reselling of names. A possible solution to this is the creation of more domain names (under consideration as of 10/23). |

Contributory infringement (and the consequential liability) is one of the most contentious areas of copyright debate. For instance, is an ISP liable for contributory infringement when it allows its users to link to hacker sites? How would recent legislation address this? See the notes for a legislative review, particularly the Goodlatte proposals for "safe harbor" procedures and "mere conduit" exemptions. |
