Right now we are only able to modify the way nodes are organized together to form conceptual trees. We do not have a way to modify the environment where the XQuery processing executes. In particular, we are not able to modify the content of collections, variables, document(). 

Without this ability, what would it mean to create a new top node unless we say how will this affect the content of collections or variables that might make this new node accessible to XQuery ?
