It would help us greatly if you were able to run the XQuery Test Suite (http://www.w3.org/XML/Query/test-suite/) and provide us with your results. Our most recent version added tests for modules. When it comes time for us to progress to PR and we consider what to do with "at risk" features, we will consider your statement, similar statements from other implementors, and the test results that we have received.
