The ODRLv2 allows for expressing "fair use" permission.

This is the list of issues the ODRL Initiative has considered, when addressing the respective requirement (see above).

issue01 - How to express/handle fair use?

Solution approaches:
- Adding a permission element for fair use (e.g. USA)/fair dealing (e.g. AUS), for example, the permission "Copyright Exceptions". Copyright Exceptions is a term for "fair use" or "fair dealing" and requires an addtional attribute to specify the Jurisdiction.
Code Example: The following permission would grant all access to the contract party "party02" to "asset01" that are stated as fair use in the US law.
