The command element defines an actionable region, with the optional checked and radio states.  Similar constructs occur both inside and outside menus.  For example, in the inbox of an online mail system, each message is actionable, and multiple selection (for deletion for example) is a common scenario.  Commands and their aspects define this UI quite well.  However, since this is not a menu, commands can't be used.
