Are we talking about (to be defined) third parties only?  Agree that tracking is about data collected over (unrelated) sites/services over time ... subject to (to be defined) acceptable uses.

Tom - I agree and should have added the prospective element as well.  Until the user provides an exception to DNT or removes it altogether, their current actions should not be profiled for advertising targeting purposes (and other activities that will fall under the eventual scope of the yet to be defined term "tracking").

I think that Tracking should not only include taking actions based on previously observed actions, but also the accrual of new records derived from current actions. I.E.:

- don't change my experience based on what you already know about me, &
- don't learn anything new about me.
