For me, the mere mention of “privacy” and especially the “right to privacy” gets us into a can of worms. As far as I know, there is no universal consensus on what those terms mean in legal contexts, and different cultures and jurisdictions may have very different views on the whole subject.

 

I remember that we had the same discussion in the Government Linked Data Working Group, and in the end their best practices did not say anything about the subject, because it really depends. Some jurisdictions grant more “right to privacy” than others, and there are several situations where certain people have a reduced right to privacy (e.g. elected officials in many places). It’s really complicated.

 

In the GLD group I argued that the most you can say is that there is an obligation on publishers to respect the laws of the jurisdiction that they are subject to. However, stating that in a Best Practice document sounds superfluous.

 

As I think I said before, I would vote for removing the whole of BP21, and make some general statement about the issue in the introduction, which I think was one of the options on the table during the F2F.

Hi Hadley and Phil,

 

During the last F2F [3], there was a long discussion about whether or not to keep the Best Practice 21: Preserve people's right to privacy. As a result of this discussion, two actions were created Action 164 [1] and Action 166 [2]. I'd like to ask your help to close these actions before the next F2F. It is really important that we can reach consensus about this BP and the the Sensitive section before the publication of the next draft.
