W3C
XForms Patent Statements

The following statements are the patent disclosures and license commitments associated with the W3C XForms deliverables and provided by members of the XForms WG as required by W3C procedure. These statements may be subject to modification based on discussions during the W3C Advisory Council review period.
W3C does not take a position regarding the validity or scope of any intellectual property right or other rights that might be claimed to pertain to the implementation or use of the technology, nor the extent to which any license under such rights might or might not be available. Copyright of the XForms specification document and other WG deliverables is vested in the W3C.

Summary of patent statements for XForms 1.0

This table summarizes patent statements for XForms 1.0 from XForms WG members who are in good standing and those in not in good standing. Either these members have provided patent disclosures and license commitments statements or have stated that they do not have intellectual property rights relating to the XForms WG. The 'license summary' column is a W3C Team characterization of the Member's statement into one of three general types of licenses: 1) Royalty-free, 2) Reasonable and non-discriminatory terms (RAND), or 3) no license offer because the Member claims it has no relevant patents. This summary is not offered to suggest the exact licensing terms. The precise terms of any licence, however, are governed entirely by the Member's statement. Names in the 'Member name' column mentionned with an * are invited experts.

1- Provided patent statements from XForms WG Members for XForms1.0

Adobe:

Adobe's been participating as a grandfathered guest from Jetform, but it is time (or past) for Adobe to comply with the new charter and WG membership. Rob's been a participant for a while, so I don't think an introduction is needed. So, simply stated, we agree to participate according to the charter at http://www.w3.org/MarkUp/Forms/2000/Charter.html from April 5, 2002 as a royalty-free working group.
I do not have personal knowledge of any IPR claims held by Adobe Systems Incorporated regarding Xforms as of the date of the submission of this statement. You can forward this to the group at largeor email archives, if required.

[X] Based upon our current knowledge, and without making an exhaustive search, we do not have essential patent claims relating to this Working Group

Declaration of Ericsson (RAND): Ericsson may or may not own patents or patent applications which apply to the "...XForms..." specifications of the W3C. Ericsson expressly disclaims any and all warranties regarding this "Contribution" including any warranty that this "Contribution" does not violate the rights of others or is fit for a particular purpose.

2- Provided patent statements from W3C Members not part of XForms WG

Shana:

Shana had a press release that claimed they had a patent that "impacts" XForms. The release used to be at http://www.shana.com/press/releases/48.asp but was removed.
The relevant quote from the release is at
http://www.xmlhack.com/read.php?item=1035 and also some bits at http://www.entrust.com/news/files/01_22_01_656.htm

XForms WG:

Digital signature: XForms 1.0 does not address signatures of digest authentication, but technically it should be possible in a future version. However, the XForms WG is aware of a patent (note: we believe the scope of the patent is outside the scope of XForms 1.0). cf. current W3C Team knowledge on the Shana Patent: http://lists.w3.org/Archives/Member/w3c-forms/2001JanMar/0105.html

Note that the disclosure at http://lists.w3.org/Archives/Member/patent-issues/2001JanMar/0025.html
does not mention XForms at all.
