I believe that the interop language proposed by aleecia in

Would be useful to add to the spec.

Note that in the next response she added a line:
No Opt-Out / No DNT Signal: Treat as 'No DNT Signal'

That doesn't look like TPE to me. It is about what to do when communication other than DNT is received in addition to DNT. Hence, it is about compliance.
